Greater email privacy won't hinder law enforcement

WASHINGTON (AP) ? A Senate bill to protect the privacy of electronic communications won't keep federal agents from combing through your inbox if they believe a crime has been committed, legal experts say. Federal and state authorities still will have a robust set of tools to track down lawbreakers even as these officials oppose changes supported by a broad coalition of technology companies and public interest groups.

The legislation, which the Senate Judiciary Committee was expected to consider Thursday, would update a 26-year-old law by requiring police to obtain a search warrant from a judge before accessing the content of all emails and other private information from Google, Yahoo and other Internet providers. Under the current law, the 1986 Electronic Communications Privacy Act, a warrant is needed only for emails less than 6 months old.

Supporters of the bill, sponsored by Judiciary Committee Chairman Patrick Leahy, D-Vt., say the changes are necessary to overhaul a law that is outdated in an era of cloud computing, cheaper electronic storage, social networking and wireless phones. Such advances in technology have dramatically increased the amount of stored communications in ways no one anticipated a quarter of a century ago.

The Justice Department has resisted the changes. The associate deputy attorney general, James Baker, urged the committee last year to consider the adverse impact on criminal and national security investigations if a warrant were the only means for law enforcement officials to obtain emails and other digital files.

But setting the bar higher doesn't prevent law enforcement agencies from doing their jobs, according to current and former prosecutors, judges and attorneys who specialize in privacy issues. Federal law enforcement authorities in four Midwestern and Southern states have been working with the more demanding warrant requirement since 2010 after an appeals court ruled warrantless access to emails was unconstitutional. To get a warrant, a judge must have proof of probable cause that a crime is being committed.

"I don't see anything (in the Senate bill) that's going to seriously concern law enforcement in terms of our ability to request warrants and to get the contents of the material that we need," said Joseph Cassilly, the state's attorney in Harford County, Md., and a former president of the National District Attorneys Association. "Since you've already got to get warrants for the stuff that's less than 180 days, it's obviously not an insurmountable standard."

Nor does the legislation weaken other methods used by law enforcement for collecting electronic information. A subpoena signed by a federal prosecutor ? not a judge ? will continue to be sufficient for obtaining routing data from third-party Internet providers that can identify the sender of an email and the location where the message was sent.

Police also can use what is known as a "D order" to get the "to" and "from" addresses of an email, but not the contents. These orders must be issued by a judge, but the agency seeking one need only show there is reasonable suspicion of a crime ? a lower legal standard than probable cause.

In a Nov. 21 letter to Leahy, 30 former federal and state prosecutors and judges said the bill would provide "a much needed judicial check on when the government can access our private digital information." Concerns that the bill would keep law enforcement from acting quickly during emergencies are unfounded, they added, because the Senate bill does not change a provision in the existing law that compels third-party providers to give the government information in situations where lives are at risk or children are being exploited or abused.

Digital Due Process, a wide-ranging coalition that includes Google, Microsoft and Twitter, as well as the American Civil Liberties Union and Grover Norquist's Americans for Tax Reform, has mounted a public relations campaign supporting the Senate bill. The coalition says updating the law will clear the "murky legal landscape" for companies and consumers alike and provide the proper safeguards for the vast amounts of information stored in server farms.

There's money at stake, too. The global market for cloud computing via the Internet is estimated to be $240 billion by 2020. But the Business Software Alliance, a coalition member that represents Apple, Intel and Microsoft, said U.S. cloud providers are at a disadvantage unless online privacy and security laws are changed. If consumers aren't sure their information is being properly protected on the remote, networked computer servers that make up the cloud, they'll take their business elsewhere.

Use of the law has been interpreted inconsistently by the courts, further fuel for those pushing for an overhaul. In a 2010 decision, the 6th U.S. Circuit Court of Appeals in Cincinnati ruled that an Ohio businessman's constitutional rights were violated when federal investigators obtained thousands of his emails without warrants. Now investigators in states covered by the 6th Circuit ? Ohio, Michigan, Kentucky and Tennessee ? must obtain warrants for all emails. But that's not the law in other federal circuits.

In the 9th Circuit Court of Appeals, which covers California, Washington, Oregon and six other Western states, judges ruled that a search warrant was required for both opened and unopened email, but only if left on a server for less than 180 days. The Justice Department has argued that a search warrant is required for unopened email left on a server for less than 180 days, but not for opened email less than 180 days old.

The decisions mean different rules apply depending where an investigation begins. How should emails be treated if a case starts in Pennsylvania and the messages are stored on a server in California, the hub for Google, Yahoo and other major Internet businesses?

"It's very confusing," said Hanni Fakhoury, a staff attorney at the Electronic Frontier Foundation in San Francisco. "Law enforcement will never admit this, but a uniform search warrant standard is easier for them."

Tomorrow is payday and I have $52.85 in cash left from last payday so that went into the coin jar. I will make a deposit into the emergency fund tomorrow. Inevitably, however, we run into email attachment size limits. You can now bypass Gmail's meager 25MB attachment size limit by using Google Drive.

By integrating its cloud storage service, Google Drive, with Gmail, Google now lets you attach files as large as 10GB (400 times larger than traditional attachments).

The feature is rolling out over the next few days. When it does for you, you'll see the new option to insert a Google Drive file in Gmail's new compose experience (there'll be a Drive icon at the bottom of the window). All you need to have is your specific file(s) saved to Google Drive. Google Drive gives you 5GB of free space and with the Google Drive app on your computer, all you need to do is save your files to the Google Drive folder.

Well, one more thing. You'll have to share the Drive files you want to attach with the recipient you're emailing, but Google lets you do that easily without leaving your email.

CEDAR RAPIDS ? Cedar Rapids Washington?s Tyler Burkle was a man with a plan.

The Warriors? junior sought the advice of head coach Matt Hatcher for a strategy between matches and it paid dividends, leading to a good start to his?plans of an improved season from a year ago.

Burkle posted two wins, helping host Washington to wins over Maquoketa and Marion?on Tuesday night. Burkle scored a pin in the Warriors? 39-30 win over the Indians, and a major decision in a 43-33 win against the Cardinals.

?It was nice,? the Warriors 160-pounder said. ?Last year I didn?t do too well. Coming into starting 2-0 is a really good confidence booster. It was nice to help out the team, too.?

He sought help for his second match, asking Hatcher how to counter the stronger, more physical foe. He implemented an attack to stay in good position and use an outside single-leg attack. He scored a couple takedowns, building a 6-3 lead before pinning the Indians? Romello Olds in?3:44.

?I went out there and did it,? Burkle said. ?I knew he was a stronger guy and a little shorter with more power. I didn?t want him to get me in anything I didn?t want to get in and control the match.?

Hatcher was impressed with Burkle?s initiative and how he was able to put together a solid performance.

?It?s a step in the right direction,? Hatcher said. ?It?s what we?ve been we?ve been trying to get out of him the last couple years.?

The success is an example for his teammates to follow. Pay attention and listen to your coaches, because?they can put you in position to win.

?He made a game plan and stuck to it,? Hatcher said. ?The outcome was exactly what we told him.?

The Warriors won eight weights against Marion, sealing the victory with heavyweight Zac Gillis? 3-2 overtime win over Mitch Ross. Mason Byrne (120), Trey Schuler (126) and Hunter Swartz (220) added falls for Washington.

In the opener, Washington was powered by forfeits, winning eight weights including a fall from Jared Eicher (170) and a decision by 120-pounder Devin Dills.

?They got more excited (in the second round),? Hatcher said. ?These kids are new and new staples, so to speak. ? We have new kids that have to make their mark and new kids who are just plain new. They fought pretty hard. The effort was there.?

Marion (1-1) dropped Maquoketa, 42-31. Levi Lochner (145) and Dakota Peterson (17o) recorded two pins apiece.

Five Cardinals were 2-0 Tuesday night. Logan Mayberry (152), Justin Zeimet (182) and 220-pounder Alex Eggers scored two falls. Dillion Pieper added a pin and decision at 106, while Beau Bowman (113) had a pin for Maquoketa (0-2).

1:25 AM: CBSSports.com?s Jon Heyman reports that the Reds and Jonathan Broxton have come to terms on a multiyear deal that is set to be announced Wednesday.

It?s expected to be a three-year pact, and one imagines it?ll come in close to Brandon League?s three-year, $22.5 million deal with the Dodgers.

The plan appears to be for Broxton to step into the closer?s role, with Aroldis Chapman joining Johnny Cueto, Mat Latos, Bronson Arroyo and Homer Bailey in the rotation. Mike Leake would work in relief.

It?s a switch with tons of upside, but also with plenty of risk. Of the three biggest relief-to-starting conversion stories last year, only one paid off: Chris Sale with the White Sox. Daniel Bard was a bust for Boston, and Neftali Feliz got hurt in Texas and needed Tommy John surgery.

And then there?s Broxton. He was a perfectly effective reliever with the Royals and Reds last year, amassing a 2.48 ERA in 58 innings. However, his margin for error certainly isn?t what it was. During his first five years with the Dodgers, he averaged at least 10.5 strikeouts per nine innings every season, topping out at 13.5 in 2009. Last year, he was all of the way down to 7.0 K/9 IP.

Personally, I?m all for taking the chance on moving Chapman to the rotation. Still, I would have gone in a different direction for a closer replacement. Re-signing Ryan Madson to a one-year deal would have been the better move.

Art contest celebrates World Heritage

An art contest, World Heritage in Your Hands, has been launched nationwide to celebrate Viet Nam?s National Day for Heritage and 40 years of the World Heritage convention. The contest aims to encourage young people 18 years of age or under to reflect upon the importance of World Heritage sites and celebrate the preservation of these sites for future generations.

Each participant should create a colourful and unique work that depicts the Viet Nam World Heritage site that they live closest to. Choices include the central sector of the Imperial Citadel of Thang Long in Ha Noi, the Citadel of the Ho Dynasty in Thanh Hoa Province, the complex of Hue monuments in Thua Thien-Hue Province, Hoi An Ancient Town, My Son Sanctuary and Phong Nha-Ke Bang National Park in Quang Binh Province and Ha Long Bay in Quang Ninh Province.

All entries should be sent to the UNESCO Ha Noi Office at 23 Cao Ba Quat Street before February 1. Images will be judged on the quality and legibility of the drawing, the originality of the image and the author?s knowledge of the heritage behind it.

Exhibition displaying Vietnamese border, sea and islands opens in Hue

An exhibition entitled ?Vietnam?s border, sea and islands? opened at the Thua Thien ? Hue Provincial Information and Culture Centre on November 25.

More than 370 photos and propaganda posters are on display featuring Vietnam?s sovereignty over its sea and islands, as well as the life of soldiers stationed in border, sea and islands areas.

The event also introduces 21 stone blocks from the Truong Sa (Spratly) archipelago, a statue featuring President Ho Chi Minh and border soldiers, and film screenings on the country?s defence achievements.

Notably, legal documents proving legal Vietnam?s undeniable sovereignty over Hoang Sa (Paracel) and Truong Sa (Spratly) archipelagoes are also showcased at the exhibition, including a 100-year-old map of the Chinese Qing dynasty showing that China?s southern territory stretches as far as Hainan island, and does not include the two archipelagoes.

The exhibition aims to assert Vietnam?s territorial integrity, raise public awareness, particularly among Party members and the young, of the strategic role of the border, sea and islands, encouraging the entire people and army to protect the country?s sovereignty over the areas.

Stamp honours former communist leader

A postal stamp depicting Communist leader Nguyen Thi Minh Khai (1910-41) has been issued by the Ministry of Information and Communications, the Party Committee and the HCM City People?s Committee.

The event marks the 72nd anniversary of southern Viet Nam?s Uprising Day and honours Khai?s great contributions to the revolutionary cause.

The uprising was suppressed in blood and Khai was sentenced to death by the French colonialists in August 1941 in Hoc Mon District in the outskirt of Sai Gon.

Khai was born in 1910 in the central province of Nghe An. She was the first and only female secretary in the Sai Gon Party Committee.

Concert pays tribute to brilliant duo

A concert to remember two famous composers, Trinh Cong Son (1939-2001) and Van Cao (1923-95), will take place on December 8 at Ha Noi Culture and Friendship Palace, 91 Tran Hung Dao Street.

Cao and Son were great names in Vietnamese music. Cao is the author of the Vietnamese national anthem, while Son is considered one of the salient figures of modern (non-classical) Vietnamese music. Their hits will be presented by leading singers such as Hong Nhung, Thanh Lam and My Linh and saxophonist Tran Manh Tuan.

Film festival highlights traffic safety

The ninth National Film Festival on Traffic Safety took place in Ha Noi with the goal of increasing awareness about obeying traffic laws.

This year, 144 films in different genres such as documentary, comedy, science-education, reportage and music were submitted by 69 organisations to compete at the festival.

The festival, held biennially by the National Traffic Safety Committee, ends today at the National Cinema Centre.

Sculptors urged to rock art competition

Vietnamese and expatriate sculptors are invited to submit their work to the Fifth National Sculpture Exhibition next year, the Ministry of Culture, Sports and Tourism?s Department of Exhibition, Photography and Fine Arts has announced.

Each sculptor can submit three works made from any materials within the 2003-13 period. The organisation will examine photos of the works in April and select about 300 to display.

Prizes will be awarded to the best sculptures on display. The first-place sculptor will receive VND30 million (US$1,500), with second and third prizes of 20 million and 15 million, respectively.

A cash prize of VND75 million will also be given to encourage 15 sculptors.

Sex tape used to bribe Chinese official goes viral

BEIJING (AP) ? A 5-year-old sex tape of an 18-year-old woman allegedly hired by developers to sleep with a city official is causing yet another scandal for China's ruling Communists in the city formerly led by fallen politician Bo Xilai.

The 50-something official, Lei Zhengfu, was fired from his position as district party secretary after the video, an apparent extortion attempt, went viral earlier this month and his jowly, pop-eyed mug became the butt of numerous Internet caricatures. But the scandal may still be growing, as a whistleblowing former journalist says he may release similar tapes of more city officials soon.

The party is already reeling from the scandal that triggered Bo's purge and further battered the party's reputation in the public mind. Chongqing, the city that he ran, has been depicted by prosecutors and state media as rife with cover-ups, abuse of power and corruption. Bo's wife was convicted of murdering a British businessman, and Bo himself faces allegations of corruption and obstruction of justice in the murder case.

News of the sex tape, which was apparently shot in 2007 but only leaked this month, comes as China's newly installed leadership ramps up anti-corruption efforts as it deals with a steady stream of bribery and graft cases that it fears has undermined its authority.

The tape exploded on the Chinese Internet Nov. 20 when screenshots of it were uploaded by a Beijing-based former journalist Zhu Ruifeng to his Hong Kong-registered website, an independent online clearing house for corruption allegations.

The lurid images, apparently taken secretly from a bedside table, show Lei having sex with a woman. Zhu told The Associated Press that the woman, whose face is not visible in the screen grabs, was hired by a construction company to sleep with Lei in return for construction contracts. The company later tried to use the tape to extort more business from Lei, he said.

Zhu says he obtained the video from someone inside the Chongqing Public Security Bureau who gave it on condition of anonymity. He said he was also given tapes implicating five other Chongqing officials but is trying to verify their content before releasing them.

Zhu said that after the blackmail attempt, Lei reported the case to Chongqing officials sometime around 2009, which led to the construction boss being jailed for a year on unrelated charges and the woman being detained for a month.

Xinhua reported Monday that Chongqing's corruption watchdog had pledged a thorough investigation of Lei, who was dismissed Friday, but said it had yet to formally receive a report about the allegations against Lei or the footage.

The China Daily in an editorial Tuesday said the case showed that the "Internet is worth being embraced by the country's corruption busters as a close ally."

It also called for greater transparency in handling this and other cases, and listed a few of the lingering questions that the salacious case has thrown up.

"Strangely, the mistress was once detained and the contractor jailed for blackmailing Lei," it said. "What had happened? ... These are crucial questions waiting to be answered."

With a younger set of incoming leaders announced this month in Beijing, the government is keen to show that those in power are worthy of their posts and that wrongdoers will be weeded out. In his first remarks to the press after being appointed as the new Communist Party chief, Xi Jinping vowed to tackle corruption.

The party's corruption watchdog underlined its zero-tolerance for graft on Monday.

"There is no place for corrupt figures to hide away within the party," the Central Commission for Discipline Inspection said in a statement quoted by the official Xinhua News Agency.

Many Chinese, however, are cynical about the allegations against high-profile party members and that they signal a true crackdown on corruption. Many think Bo was no more or less dirty than the average Chinese politician and that he was deposed not for his behavior but because he was on the losing end of factional power struggle.

Xiao Weilong, 30, an insurance salesman in Beijing, bemoaned how "ordinary people can't do anything about" cases such as Lei's.

"These sorts of abnormal things have become the norm, and we don't have any say," he said Tuesday.

Zhu, the journalist who broke the Lei story, said the fact that his website had not been blocked despite the allegations it outlined was a possible sign that the government is more serious than in the past getting tough on corruption.

"Possibly what we are seeing is that the new leaders are perhaps taking steps toward enforcing the constitution, a sliver of a new dawn," he said.

Katy Grimes: Former?Democratic campaign treasurer Kinde Durkee is facing only an 8-year sentence, even after she was?arrested on charges of mail fraud and defrauding Democratic campaigns of millions of dollars.

The Sacramento Bee reported?Monday that Federal prosecutors are planning to ask a judge to sentence Durkee?to only eight years in federal prison for a record case of campaign fraud.

Durkee had access to more than 400 Democratic campaigns, political action committees and club accounts, and was found guilty of wiping out many of the accounts and stealing from active Democratic campaigns, including from U.S. Sen. Diane Feinstein of San Francisco.

A not so secret past

Durkee not only pleaded guilty to stealing more than $7 million from Democratic campaigns in 2011, the campaign treasurer had a sketchy history that was not a secret.

?Many ask why Democrats allowed Durkee to continue as a treasurer despite campaign violation?fines?totaling?$185,000, as well as criminal investigations by the Los Angeles County district attorney?s office in 2008 and 2009, the Los Angeles Times?reported,? I wrote in a story in Oct. 2011.

State Democrats appealed to the state Fair Political Practices Commission for a change of state campaign rules to help alleviate the pain of Durkee?s massive theft of the campaign funds. But they did this only after telling victims of financial swindles in California that they would get no special tax relief from the state.

State?Sen. Joel Anderson, R-San Diego, authored a 2011 bill which would have provided tax relief for victims of fraudulent investment schemes similar to the?Bernie Madoff case, by allowing a tax deduction for losses attributable to criminal investment fraud.?Victims of financial fraud are allowed tax relief in many other states and by the federal government.

But Democrats in the?Senate Committee on Governance and Finance?killed the bill, sponsored by State Treasurer Bill Lockyer.

Democrats in the governance committee stated they voted against Anderson?s bill because ?tax relief policies would decrease state revenues and exacerbate the state?s multi-billion dollar budget deficit.?

Then Democrats asked the FPPC to be able to accept additional contributions to rebuild the money stolen by Durkee from campaign accounts.

Durkee?s fraud case

Federal prosecutors found that Durkee had used campaign money to pay her personal credit cards, home mortgage, business-related bills and even for her mother?s assisted-living facility. Durkee apparently created a sophisticated cover-up scheme shifting funds between candidates? accounts to cover up the theft.

At her sentencing hearing this week, it is also expected that a restitution amount should be announced. ?But I?m not sure that Democrats expect to get any money back either through more fundraising, or from squeezing blood from the turnip.

Being a fraud victim stinks, doesn?t it?

Obama to meet executives, go to Pennsylvania for fiscal push

WASHINGTON (Reuters) - President Barack Obama will launch a multipronged push this week to garner support for his proposals to solve U.S. fiscal problems, meeting with business executives at the White House and visiting a small business in Pennsylvania to press his case.

Obama has sought to go on the offensive since his re-election on November 6 in the fight with Republicans over the "fiscal cliff" - a combination of tax increases and spending cuts that would go into effect next year if the two sides do not reach a deal to stop it.

As part of that effort, the White House released a report on Monday showing the impact that middle class tax increases would have on consumers and the retail industry.

On Tuesday, a White House official said, the president will meet with a group of small-business owners. On Wednesday he will host an event with "middle class Americans who would be impacted if Congress fails to act to extend the middle class tax cuts," the official said. He will also hold a meeting with business leaders, something he has done previously.

On Friday, he will visit a manufacturing facility of The Rodon Group, a small business that is a manufacturer for K'NEX Brands, a toy company with products including Tinkertoy and Angry Bird Building Sets.

"The president will travel to Montgomery County, Pennsylvania, to continue making the public case for action by visiting a business that depends on middle class consumers during the holiday season, and could be impacted if taxes go up on 98 percent of Americans at the end of the year," the official said.

Obama's visit and his meetings at the White House are designed to put pressure on congressional Republicans to extend tax cuts for middle-income people while ending them for families who make more than $250,000 a year.

Gaining the support of the business community is a key part of Obama's strategy. Reinforcing that, the White House released an analysis by its National Economic Council that said millions of small-business owners would suffer if the middle class taxes went up next year.
